A New Jersey real estate brokerage commission lawsuit is a New Jersey real estate lawsuit between a New Jersey real estate broker and a New Jersey real estate buyer, New Jersey real estate seller, New Jersey real estate landlord and/or New Jersey real estate tenant.

A New Jersey real estate brokerage commission agreement or New Jersey real estate brokerage contract is a New Jersey real estate broker commission agreement or contract between a New Jersey real estate broker and a New Jersey real estate buyer, New Jersey real estate seller, New Jersey real estate landlord and/or New Jersey real estate tenant. The amount of the commission is an essential term of the New Jersey real estate brokerage commission agreement or New Jersey real estate brokerage contract. A New Jersey real estate contract lawsuit defendant's implied promise to pay a New Jersey real estate brokerage commission could be unenforceable because of the New Jersey real estate broker commission lawsuit plaintiff and defendant' failure to agree on the amount of the New Jersey real estate brokerage commission.

WHAT IF THE NEW JERSEY REAL ESTATE BROKER DOES NOT HAVE A WRITTEN NEW JERSEY REAL ESTATE BROKERAGE AGREEMENT OR A WRITTEN NEW JERSEY REAL ESTATE BROKERAGE CONTRACT?
Under the New Jersey Statute of Frauds, failure to comply with the strict requirements of the New Jersey statute of frauds may prevent a New Jersey real estate broker from recovering a New Jersey real estate commission on a quantum meruit or unjust enrichment theory. New Jersey law requires that if a New Jersey real estate broker commission agreement between a New Jersey real estate broker and the New Jersey homeowner of real estate is to be enforceable, it must be in writing. There are, however, certain exceptions allowed by New Jersey real estate contract law. Even though a New Jersey real estate broker commission agreement between the New Jersey real estate broker commission lawsuit plaintiff and defendant is originally only verbal, a New Jersey real estate broker may recover the New Jersey real estate broker’s commission provided the New Jersey real estate broker or the New Jersey real estate broker’s agent has, within five (5) days of the verbal agreement, given written notice to the New Jersey homeowner, setting forth the terms of the New Jersey real estate broker commission agreement including the rate or amount of compensation agreed on and further provided the New Jersey real estate broker actually effects a sale or exchange of real estate prior to termination of the New Jersey real estate broker agreement. A New Jersey homeowner may act to terminate such a verbal agreement even after the New Jersey homeowner received a written notice provided a sale or exchange has not yet been affected and further provided the New Jersey homeowner gives written notice of the termination to the New Jersey real estate broker or New Jersey real estate agent. However, when notification from the New Jersey homeowner occurs while the New Jersey real estate broker is conducting good faith negotiations with a prospective buyer, and then the New Jersey homeowner subsequently sells to or exchanges property with that buyer, the notice of termination by the New Jersey homeowner is ineffective and the New Jersey real estate broker may recover the New Jersey real estate broker’s commission notwithstanding the termination notice by the New Jersey homeowner. A New Jersey real estate broker commission agreement must not only satisfy the requirements of the statute in order to entitle a New Jersey real estate broker to a commission, it must also either expressly or impliedly signifies an engagement of the New Jersey real estate broker to sell the property on behalf of the New Jersey homeowner. In determining whether such an implication is warranted, it is permissible and sometimes essential to scrutinize all of the surrounding circumstances. What this means is that the New Jersey real estate broker commission agreement must do more than merely advise that if the New Jersey homeowner should decide to sell at some future time, the terms contained in the New Jersey real estate broker’s commission agreement will apply. The New Jersey real estate broker commission agreement must actually authorize the New Jersey real estate broker to secure a purchaser on the terms specified.
