WHAT IS THE NEW JERSEY LEMON WHEELCHAIR LEMON LAW?
Every state in the United States of America has a type of New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter lemon law designed to protect consumers who purchase defective New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooters. A "lemon" New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter is one that exhibits a substantial problem or problems following repair attempts made to it.

Motorized New Jersey wheelchairs and New Jersey motor scooters can cost up to $20,000.00. Accordingly, New Jersey’s lawmakers decided that the public should be protected from New Jersey motorized wheelchair lemons and New Jersey Lemon motor scooters by having a right to sue the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter’s manufacturer for a refund of the New Jersey Lemon motorized wheelchair’s purchase or lease price or New Jersey Lemon motor scooter’s purchase or lease price, less a deduction for how many miles the defective New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter had when the defect was first reported to the New Jersey wheelchair manufacturer or New Jersey motor scooter manufacturer or its authorized the New Jersey Lemon motorized wheelchair dealer or New Jersey Lemon motor scooter dealer.

IS MY NEW JERSEY LEMON MOTORIZED WHEELCHAIR OR NEW JERSEY LEMON MOTOR SCOOTER A LEMON UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW?
Under New Jersey’s New Jersey Lemon Wheelchair Lemon Law, New Jersey motorized wheelchair manufacturers and New Jersey Lemon motor scooter manufacturers must provide the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyers of New Jersey Lemon wheelchairs and New Jersey Lemon motor scooters a minimum warranty of 1 year for defects impairing the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter’s use, value or safety. It applies to New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooters purchased after the date of the New Jersey Wheelchair Lemon Law’s enactment (1996).

For the New Jersey Wheelchair Lemon Law to apply, the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer’s New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter has to meet the following requirements:

1. be a new or "demonstrator" New Jersey Lemon wheelchair; or

2. be a New Jersey motorized scooter designed primarily for indoor use, or

3. be a retrofitted power unit intended to motorize a New Jersey Lemon wheelchair; and

4. if a New Jersey Lemon wheelchair or New Jersey motorized scooter, be designed to help promote independent living and mobility for medical reasons; and

5. be purchased or leased in New Jersey; and

6. during the first 1 year following delivery, have a defect substantially impairing the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter’s use, value or safety; and

7. the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter’s defect must either:

a. be unable to be fixed by the New Jersey wheelchair manufacturer or New Jersey motor scooter manufacturer’s authorized dealer after a reasonable number of repair attempts [usually 3 repair attempts]; or

b. place the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter out of service for 20 or more days.

WHAT MUST I DO UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW?
During the first year following delivery, the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer must make arrangements to get the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter fixed by the New Jersey wheelchair manufacturer or New Jersey motor scooter manufacturer or its authorized the New Jersey Lemon motorized wheelchair dealer or New Jersey Lemon motor scooter dealer.

WHAT MUST THE NEW JERSEY WHEELCHAIR DEALER OR NEW JERSEY MOTOR SCOOTER DEALER DO UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW?
During the first year following delivery, the New Jersey wheelchair manufacturer or New Jersey motor scooter manufacturer or its authorized the New Jersey wheelchair dealer or New Jersey motor scooter dealer must make arrangements to fix the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter. If unable to fix the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter’s material defect after at least 3 repair attempts, or if the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter was out of service for 20 days while the New Jersey wheelchair dealer or New Jersey motor scooter dealer was trying to fix it, the New Jersey wheelchair dealer or New Jersey motor scooter dealer must accept the return of the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter from the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer and provide the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer with a replacement or early lease termination, minus a reasonable use allowance.

HOW DO I GET A REFUND OR MONEY DAMAGES UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW?
If the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer is unable or unwilling to fix the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter within a reasonable period of time and refuses to provide a replacement or refund of the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter, the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer can file a New Jersey Lemon motorized wheelchair lawsuit or New Jersey Lemon motor scooter lawsuit against the New Jersey wheelchair manufacturer or New Jersey motor scooter manufacturer in a New Jersey Court. If the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer wins the New Jersey Wheelchair Lemon Lawsuit, the New Jersey Lemon motorized wheelchair lemon buyer or New Jersey Lemon motor scooter lemon buyer can recover money damages. If the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer leased the New Jersey Lemon motorized wheelchair or New Jersey Lemon motor scooter, to receive a refund from the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer, the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer shall: (1) offer to return the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter to the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer. No later than 30 days after that offer, the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer shall provide the New Jersey lemon refund to the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer. When the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer provides the New Jersey lemon refund, the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer shall return to the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter having the nonconformity; and (2) the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer shall offer to transfer possession of the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter having the nonconformity to its manufacturer. No later than 30 days after that offer, the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer shall provide the New Jersey lemon refund to the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter lessor. When the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer provides the New Jersey lemon refund, the New Jersey lemon motorized wheelchair buyer or New Jersey lemon motor scooter buyer shall provide to the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer any endorsements necessary to transfer legal possession to the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer.

DO I HAVE AN OPTION OF A NEW JERSEY LEMON REFUND OR NEW JERSEY LEMON REPLACEMENT UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW?
If, after a reasonable attempt to repair the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter, the nonconformity is not repaired, the New Jersey wheelchair lemon manufacturer or New Jersey motor scooter lemon manufacturer shall: (1) At the direction of a the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer, other than a the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer who leases a motorized wheelchair from a motorized wheelchair dealer, do either of the following: (a) Accept return of the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter and replace the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter with a comparable new motorized wheelchair and refund any collateral costs; or (b) Accept return of the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter and refund to the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer and to any holder of a perfected security interest in the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer's motorized wheelchair, as their interest may appear, the full purchase price plus any finance charge amount paid by the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer at the point of sale and collateral costs, less a reasonable allowance for use. (2) With respect only to the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer who has leased a motorized wheelchair from a wheelchair lessor, accept return of the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter, refund to the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter lessor and to any holder of a perfected security interest in the New Jersey lemon motorized wheelchair or New Jersey lemon motor scooter, as their interest may appear, the current value of the written lease and refund to the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer the amount that the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer paid under the written lease plus any collateral costs, less a reasonable allowance for use.

IF I RETURN MY LEASED NEW JERSEY LEMON MOTORIZED WHEELCHAIR OR NEW JERSEY LEMON MOTOR SCOOTER TO THE MANUFACTURER UNDER THE NEW JERSEY WHEELCHAIR LEMON LAW, WHAT HAPPENS TO MY NEW JERSEY LEMON MOTORIZED WHEELCHAIR LEASE OR NEW JERSEY LEMON MOTOR SCOOTER LEASE?
A New Jersey motorized wheelchair lease or New Jersey lemon motor scooter lease shall not be enforced against a after the New Jersey Lemon motorized wheelchair buyer or New Jersey Lemon motor scooter buyer receives a refund for the leased motorized wheelchair pursuant to the New Jersey Wheelchair Lemon Law.
